Yep, that’s what Anita Lee has for us today. As you recall, Alabama federal judge William Acker fined sisters Cori and Kerri Rigsby $65K to cover their former employer E.A. Renfroe’s costs of pursuing State Farm records they took and gave to Dickie Scruggs. Dickie appealed the fine, Acker decided the Rigsbys have to pay it, and yesterday Dickie asked Acker to let him pay it — but give him a refund if his appeal succeeds.
However, Anita reports,
Renfroe argued it is entitled to collect the money from the Rigsbys and that Scruggs’ offer is “illusory” and conditioned on his appeal.
Acker set a hearing at 10 a.m., July 28 in Birmingham, where Renfroe filed the lawsuit almost two years ago. If Acker decides the Rigsbys should pay the fine, it will be due a day later. Renfroe’s contract case against the Rigsbys has yet to be tried.
Well, as if John Keker & Co’s Monday weren’t already busy enough, what with not only this hearing but Dickie’s deposition in the Zuckerman Spaeder case. I don’t think anyone’s told where that’s to occur, but the Mid-South sky may fairly teem with private jets, so watch out.
Why doesn’t Renfroe just ask Acker if they can send a mob over to beat up the Rigsby sisters? We know from his precedents that he would approve it.
When courts lose the ability to enforce orders above board, Researcher, felons like Dickie Scruggs afford them the same respect and dignity he afforded Judge Lackey. Betcha attempting sweet potato delivery to a pillar of the judicial community like Judge Acker has been stricken from his and the Rigsby’s arsenal of weapons — this ain’t one of Dickie’s magic jurisdictions.
Scruggs’ Monday will be busier than you think Lotus. Remember that case Jones v. Scruggs? Well, if I recall correctly, NMC reported Scruggs would be called to testify on July 28 in that case.
So he has the infamous fee dispute to deal with, and two issues dealing with (as NMC calls it) The Blob?
I guess life before the slammer is a busy time for folks.
