Zach Scruggs sentenced to 14 months

Judge Biggers and  Mike Moore had words (to the point that Judge Biggers told Mike Moore to quit interrupting).  The defense side was so unprepared for a sentence with jail time that Mike Moore stated to the court that they knew other defendants had asked for the court to make a recommendation as to a specific place to serve the time, but “We were not prepared to do that.  We have not given any consideration about where Mr. Scruggs would go.”

    Biggers is ridiculous. His personal animosity toward the Scruggs family could not be more transparent.

    Captain, maybe what you are seeing is Judge Biggers’ animosity for what these men have done to the legal profession, their co-counsel and their oaths taken when they became officers of the court on which Judge Biggers serves. Remember, this young man being sentenced before him this morning referred to a judge he knew nothing about as an “asshole.” Just a thought.

    You know I really feel for Zach and wish he could have gotten probation, particularly with young child and one on the way, I believe it would have been possible if others had taken greater responsibility as they should have. BUT that said I don’t believe Judge Biggers has animosity towards the Scruggs family I believe he has great animosity for what was done and Zach’s statement that all I was involved in was the attempt to earwig the Judge just doesn’t sit well with me and obviously Judge Biggers. As I have stated before the “earwigging” scheme is more dangerous than the bribe, at least with a bribe you have a chance to catch bec it creates a money trail . Whereas hiring a lawyer who is a friend of the Judge to go talk to him or influence if you will is as bad if not worse than the bribe.

    And if it matters the judge refered to as an “asshole” has done more and continues to do more to serve the law than most. Judge Lackey is lawyer-friendly and patient to a fault, a fine fellow and a great American.

    We have all heard about folks trying to break out of jail. Mike Moore did his level best to break his client into the penitentiary.

    And then to top it off with his babble about not even having contemplated imprisonment. On first blush it just sounds stupid and unprepared. On second blush the incredible arrogance of such a statement(true or not) hits you in the face –the absolute equivalent of having said “why, we never even considered this to be a big enough deal that he could ever do time.”

    I guess Moore is just too used to swinging around the prosecutorial power of the State. Sure would not want him “defending” me.

    If Moore wasn’t prepared for jail time at a sentencing hearing, then what was he prepared for? I wonder if Zach walked out of the courthouse with his nose in the air?
