Ever heard of the frying pan and the fire, Judge Yerger?

April 1st, 2008 @ 9:30 am - by lotus · 20 Comments

Aw gawd. Jerry Mitchell (emph. mine):

Hinds County now has more special circuit judges than it does elected ones.

Senior Hinds County Circuit Judge Swan Yerger announced Monday two former Hinds County circuit judges will take over the duties of Judge Bobby DeLaughter, temporarily suspended by the state Supreme Court pending a hearing on complaints filed against him. “We won’t have to miss anything,” Yerger said.

Special Circuit Judge L. Breland Hilburn will handle all criminal cases, and he will split civil cases with Special Circuit Judge William Coleman. That brings the total number of special judges to four. With the loss of DeLaughter, Hinds County is down to three regular circuit judges.

“It’s good to know we have relief,” Hinds County District 1 Supervisor Robert Graham said.

Until learning of Yerger’s plans, he and Hinds County Sheriff Malcolm McMil-lin had talked of asking state Chief Justice Jim Smith to appoint an interim replacement for DeLaughter.

“As you know in Hinds County, we can’t afford to have a judge down one day,” Graham said. “Judge DeLaughter is very capable and our most productive judge.”

The rest of the story details the court schedule, staffing, and salary provisions, as well as repeating Senior Judge Billy Bridges’ assignment to Wilson v. Scruggs and the customary Mitchell backgrounder on DeLaughter. But once I hit “L. Breland Hilburn,” I got too busy shaking my head to pay much attention.

Needless to say, folo suggests that Graham and McMillin had the better idea.

For those of us whose recall of the folo archives is less than total, a link to something about Judge Hilburn would be usefully remedial.

I hate to bring this up, but does this mean that Judge Yerger plans to continue to assign all major felonies to the white judges only? here’s a blog post on this. Here’s another story about the judicial assignments in Hinds County.

With Kingfish in the blog post linked, I’m not talking about the judges involved but how these assignments appear.

    Apologies, Anderson. Remedial link added.

Special Circuit Judge William Coleman is the judge appointed to hear the Jones v. Scruggs, et al. case in Oxford.

so last night when they showed Bridges hearing a Hinds County criminal case on WLBT how did he get that assignment? I thought he was already appointed to cover for Delaughter- it certaintly wasnt a matter that was related to the Wilson case-

  8. NMC says:

I am told that after the Miss. Sup. Ct. heard from the Magnolia Bar and the Hinds County bar about this issue since the December 2007 stories about it, Trent Walker, a young black lawyer in Jackson, was appointed as a special circuit judge to help with the criminal-docket-clearing issues.
