It’s not exactly the dog that did not bark here, but one very notably missing piece of the United States v. Scruggs saga is the order (as it turns out from today’s offer of evidence, two orders) that Tim Balducci allegedly bribed Judge Henry Lackey to enter. Both would have referred the case to arbitration.
Today marked the first public appearance of those orders, as far as is known to Folo and its friends. Now that they are marked as (as yet unadmitted) exhibits, they are public information, and a friend who’s been in the courthouse sends them on. Here’s the first one, and here’s the second one. These are copies of what was offered into evidence by Grady Tollison in his proffer on Monday.
One thing to note: On both orders, the stamp from the fax machine is PATTERSON BALDUCCI — excuse me, Patterson isn’t even a lawyer and he’s listed first? Anyhow, read them tonight. A ruling (far more fair and far more square) is anticipated tomorrow from Judge Coleman in Oxford.
NMC, my non-lawyer brain needs help. What is it you consider a “more fair and square agreement”?
“agreement” is the wrong word, nowdoucit– the two documents were orders, and I was being slightly snarky. The implication was that I was presuming Judge Coleman was about to rule based upon the legal arguments, while the orders Balducci drafted, if signed, would have been based on bribery.
The snarkiness may have been partly the result of tiredness. I’ve tried to work all day, while posting a WHOLE LOT of news to fellow obsessives on this site.
And there’s more news! I’ve got it mentally divided into: Is this confirmed enough to post? And: Am I too tired to keep posting this news? Some of both, and some is both.
I completely understand NMC. A hard day of nailing jello to a tree has just flat worn me out.
Ooo-wee, NMC, now that I’ve finally caught up to y’all (you know that sign you see in some offices, “WHERE are they? WHICH WAY were they headed? HOW MANY of them? I MUST find them, I am their LEADER!” Well, … ) . . .
